1. GOODS AND SERVICES

rootafrica.co.za is the online retail & wholesale trade website for Root of Africa trading in herbal products. All products offered on this web site are classified as food supplements or non-scheduled herbal supplements that can be purchased freely without prescription. Root of Africa reserves the right not to sell these products to countries that may have restrictions on the import of such goods.
2. PAYMENT TYPES, OPTIONS AND METHODS
Root of Africa accepts credit card and other card payments via the Internet. Where customers cannot pay with cards we accept direct bank deposits via EFT.
2.1 CARD PAYMENTS: In order to ensure that credit card transactions are affected safely and effectively Root of Africa uses safe online payment gateways facilitated by Yoco for all transactions
2.1.1 At the time of placing the order, the transaction details are presented to the bank and an authorization is obtained for the amount of the order.
2.1.2 Payment and proof of payment (POP) are needed before orders are despatched.
2.1.3 Note that to protect it’s own and the interests of customers, Root of Africa scrutinizes all transactions very carefully to prevent attempted fraud and a transaction may be refused if Root of Africa is not satisfied with it’s legitimacy.
3. COSTS
3.1 PRICES
3.1.1 The price of each product is displayed with the product. In the event of a sale or special offer, the discounted price is displayed.
3.1.2 Prices are stated in South African Rands (ZAR)
4. SETTLEMENT, FULFILMENTS AND DELIVERY POLICY
4.1 Goods are dispatched within 12 hours of receiving confirmed payment for goods from the buyer, unless a purchase takes place on the weekend or public holidays in which case goods will be dispatched within 12 hours of the first working day thereafter.
4.2 Goods will not be dispatched until payment has been received in full for goods by Root of Africa.
4.3 Goods are dispatched using appointed courier services or Postnet. Bulk orders are facilitated by freight agents – unless a specific freight agent is appointed by the buyer, Root of Africa uses its own established freight agency.
4.4 Root of Africa will process transactions where permits or any other legal paperwork are required for exports into foreign countries.
5. SECURITY
5.1.1 Any person that delivers or attempts to deliver any damaging code to this web site or attempts to gain unauthorized access to any page on this web site shall be prosecuted and civil damages shall be claimed in the event that Root of Africa suffers any damage or loss.
5.1.2 The user allows Root of Africa to take all reasonable steps to ensure the integrity and security of the Root of Africa site and back-office applications.
6. PRIVACY
6.2.1 Root of Africa shall take all reasonable steps to protect the personal information of Users. To this clause, “personal information” shall be defined as detailed in The Protection of Personal Information Act (POPIA) The POPIA may be downloaded from: https://popia.co.za
6.2.2 Root of Africa may electronically collect, store and use the following personal information of Users:
6.2.2.1 name and surname;
6.2.2.2 country of residence;
6.2.2.3 closest city;
6.2.2.4 e-mail address;
6.2.2.5 IP address and
6.2.2.6 non-personal browsing habits and click patterns.
6.2.3 Root of Africa collects, stores and uses the abovementioned information for the following purposes:
6.2.3.1 to greet the User when he/she accesses the Root of Africa web site;
6.2.3.2 to compile non-personal statistical information about browsing habits, click-patterns and access to the Root of Africa web site
6.2.4 Information detailed above is collected either electronically by using cookies or is provided voluntarily by the User. Users may determine cookie use independently through their browser settings.
6.2.5 The user may elect not to receive any communications from Root of Africa and/or its partners / affiliates.
6.2.6 Root of Africa may collect, maintain and save any information collected from users, subject to the following provisions:
6.2.6.1 Root of Africa shall not disclose personal information from Users unless the User consents thereto;
6.2.6.2 Root of Africa shall disclose information without the User’s consent only through due legal process; and
6.2.6.3 Root of Africa may compile, use and share any information that does not relate to any specific individual.
6.2.7 Root of Africa owns and retains all rights to non-personal statistical information collected and compiled by Root of Africa.
7. STOCK AVAILABILITY
7.1 Stocks of all goods on offer are limited. Root of Africa shall take all reasonable efforts to discontinue the offer as soon as stock is no longer available. However, should items still be offered after stocks are sold, Root of Africa shall only be liable to refund monies where it is unable to fulfil orders at advertised prices.
8. HEALTH DISCLAIMER
8.1 The products and the claims made about specific products on or through this site have not been evaluated by SAHPRA (South African Health Products Regulatory Authority) and are not approved to diagnose, treat, cure or prevent disease. Under no circumstances shall Root of Africa, its licensors, suppliers or any third party mentioned on the web sites be liable for any damages whatsoever (including, without limitation, incidental and consequential damages, personal injury, wrongful death)
8.3 Indemnity – By using the web site you agree to indemnify Root of Africa, Root of Africa its employees, directors, agents, licensors, suppliers and holding company from and against any claim, action, demand, settlement or liability resulting from, or alleged to result from your violation of these Terms and Conditions of Use.
9. CHANGES TO THIS AGREEMENT
9.1 Root of Africa may, in its sole discretion, change this agreement or any part thereof at any time without notice.
